A youth minister was charged with strangling his 13-year-old neighbor, about a month after the teen's body was discovered in a park, authorities said. The body of seventh-grader Stephen Donald Tomlinson was discovered by some teenagers walking through the county park (12/8/05).

Joshua Rosa, 19, was arrested at his job at a Sports Authority after DNA evidence linked him to the slaying of Stephen Tomlinson, the Hillsborough County's sheriff's office said. Rosa was being held without bail on a murder charge. He made his initial court appearance Saturday, but it was not known if he had an attorney, a jail official said.

Detectives said Tomlinson's blood was found on Rosa's hands and on a pair of white gloves and fingernail clippers which Rosa was carrying. Hillsborough County Sheriff David Gee said the clippers were probably used to "remove evidence."

Rosa gave several misleading statements when detectives interviewed him, and he had been under constant surveillance for the past weeks, Gee said.

What will be 'the smoking gun' for this jury in arriving at a verdict?

In the closing arguments, both sides tried to emulate how they envisioned the Colt 22 was used either by Neil to murder his wife and beautiful daughter. Or, by Rachel in a suicide / murder scenario. In this news clip, segments from both the prosecution and state's closing statements are shown demonstrating the placement of the gun. What do you think? How important is the gun, GSR going to be as a contributing factor for this jury to arrive at a verdict.

Here we go. Today in Stephanie Page's cross of Dr. William Zane, one of the apparent defense theories that is raising it's ugly head is suicide. That theory being that Rachel committed suicide and murdered her own baby Lilly. As some of you will remember, that was the bizarre theory that the Mark Jensen's defense submitted. That his wife, Julie Jensen plotted to set her husband up for murdering her and thereby chose to die an excruciating death by pouring herself a glass of anti-freeze.

Ilinois coroner John Scott Denton was asked to review Julie Jensen’s death for the defense. In Dr. Denton's report for the defense he concluded that Julie committed suicide and was not murdered.   Dr. Denton presented his theory that Julie committed suicide by poisoning herself at the trial. Refer to the below RealityCanBeEvil clip.




But in the brilliance of the prosecution cross examination by
Jambois he was able to persuade  Dr. Denton to basically recant his report and findings that Julie had committed suicide. Refer to the clip below.

Also, a common statement in cross appears to be
"things are not always what they appear to be".   I will be uploading a vid clip where that statement has been mentioned during cross of witnesses.

Selective clips from today's testimony revealing the internet keystrokes of Neil Entwistle between January 17 - 20, 2006. The tracking of the accused murderer during these days are critical. - the days that lead up to and including the date of the double homicide of his wife, Rachel Souza Entwistle, and his nine month baby, Lillian.
Neil Entwistle was searching for job posting sites, eBay / PayPal (where he had been running an internet scam operation), AdultFriendFinder, HalfPricedEscorts, BlondeBeauties - you get the picture. Specifically googled, "how to kill with a knife", "where to stab a body!, "knife in neck to kill" and "quick suicide methods". Finally a search to get out of Dodge quickly - Cheap Tickets to book his speedy one way return to the UK after the double homicide.

JMCO - I believe the judge purposely cut the questioning of the witness Larry Davis at that particular point - there must be a "gotcha" internet search to be in entered into evidence.

The unwrapping of the evidence today was gut wrenching. The pillow case, Lilly's small sleeper and Rachel's pajama top. Testimony continued this morning with Deanna Dygan a chemist from the MA State Crime Lab. I am capturing the testimony today - let us all pray that the feed is not jerky, audio good and all goes well. I will not be uploading until later in the day due to prior commitments (hey a gal has to make money). However, here are some stills I have captured from the unwrapping of the evidence.

The jurors in a long-running Australian drugs trial were discharged in disgrace yesterday after it emerged that some of had spent more time in court playing Su Doku than they had listening to the evidence.

More than 100 witnesses had testified in the case of two men who faced life sentences for an alleged conspiracy to make a large amount of amphetamines. One man was charged with further firearms and drug possession offences.

The jurors had been commended by the judge for their diligence as they spent 66 days in the jury box, studiously taking notes.

After three months, both prosecution and defence were to have made their closing arguments this week. Then last week both of the accused noticed, while giving evidence, something that more than 20 police witnesses had not: that some of the jurors were writing vertically rather than horizontally. The culprit was Su Doku, the popular numbers puzzle from Japan in which players have to complete a 9x9 numbers grid.

“We were informed early on Monday of last week that that’s what was happening in the jury box and then subsequent to that I ... sort of took note to watch what was happening,” Robyn Hakelis, one of the defence lawyers, said outside the court.

“I noticed they were writing in all different directions and straight away I thought, ‘they’re not taking notes like we thought they were’. Everyone assumed they were taking notes.”

In a twist worthy of a television drama, the jury was effectively on trial as the judge heard evidence from the co-accused, a solicitor and the jury forewoman. She admitted to the judge yesterday that four or five jurors had been playing games since the second week of the trial but that Su Doku had not distracted her “too much” from proceedings.

“Yes, it helps me keep my mind busy paying more attention,” she said after being questioned by the judge. “Some of the evidence is rather drawn out and I find it difficult to maintain my attention the whole time.”

She said that jurors had photocopied Su Doku sheets to play during the trial and compare during meal breaks. The forewoman admitted to having spent more than half of her time in court playing the game.

Judge Peter Zahra summarily discharged the jury at Sydney District Court, aborting a trial that had cost taxpayers an estimated A$1 million (£490,000) since March 4 in lawyers’ fees, staff wages and court running costs.

He told the forewoman that she and her fellow Su Doku players had let down their peers on the jury and everyone else associated with the trial. They face no penalty, however, because inattentive behaviour in the jury box is not an offence.

A new trial is expected to begin in a few weeks after a new jury is empanelled.

"I think it’s disappointing more than anything that in a trial the evidence would not have been listened to. And jurors are sort of the judges of the facts and it’s very disappointing they weren’t giving our clients a fair trial,” Ms Hakelis said.

Elliot Weinstein has started to do his cross of the technicians from the MA State Crime Lab. If there is any place that "reasonable doubt" may be planted, the possible incompetency of the MA State Crime Lab may be it. Examples are: chain of custody of the evidence, contamination of the crime scene, procedures (or lack thereof) at Crime Lab. As previously blogged, the MA Crime Lab did not get a flying colors review from an independent audit in 2007.

YouTube Entwistle uploads update: Saturday June 14th

June 12 -13th videos in process of being uploaded: As some of your Neil Entwistle trial aficionados know on Thursday John Soares (Crime Lab MA State Police) took the stand. His testimony on Thursday was all direct by Michael Fabbri. It was not until Friday the 13th (appropriate heh) that Mr. Eliot Weinstein had his way with the witness. I will start my weekend hobby by uploading the John Soares testimony starting from Thursday - finishing on Friday.

Note: The live feeds on both Thursday/Friday sucked (it's a technical term). Especially Friday - the frame rate was all off & the audio was choppy - it was similar to watching a stuttering contest. There is nothing I can do about that!

YouTube Entwistle uploads update: Friday the 13th

Ladies and gentlemen of the jury. I just want to post an update on the progress (or lack thereof) of posting the vids to UT for the Neil Entwistle double murder trial. Please comment on my UT vids - I loove comments :) That is the major reason I do this channel.

General comments and frustration on the quality of courtroom feed. I keep multiple feeds up and it is frustrating to try to capture a good quality simultaneously of video and audio. My definition of a great feed is one feed that has crisp, non jerky frames (i.e. no ghosting on frames) as whiles as AUDIO. Sometimes one feed has great audio but ghosting - and the the other has crisp frames but nada audio. I could go down a rabbit hole & try to merge the audio/clips from different sources, align, yada yada. But can we talk? I am not trying to deliver this product at a production quality level - it is just moi and my keystrokes. So sometimes I am "slamming the clips" on to UT fully away that there is jerky-ness in the frame rate (as captured from original feed) and whatever.

Organization of the clips: The # in the UT video label corresponds to the sequence of events during the day. If I am uploading out of order (because there is some juicy clip that needs to be uploaded pronto) - you may see a jump in Sequence # in UT uploads. That means, time and personal bandwidth availability, I will get the "missing block" of vids uploaded.

To be fair, it is easy to assume guilt when all that has been heard for three days is the prosecution case and these witnesses are friends and family. If your friends and family will not testify on your behave after you have been murdered then we are all damned.

Unfortunately, there are two real components of the state's case that are not without doubt. And doubly unfortunate, these components are typically important in the prosecution of a murder trial.

Massachusetts State Crime Lab This operation is not Miami Las Vegas - there is no Grisham to save the day. In July 2007, The Innocence Project, prepared a extremely critical report on the sad state of affairs at the MA State Crime Lab.

If that wasn't bad enough, the Medical Examiner on the Entwistle autopsy, Dr. William Zane, in 2007 was ordered off of autopsy duty after royally messing up evidence for a visible murder trial. Dr. Zane's autopsy error forced prosecutors to downgrade murder charges against twin brothers from Ayer will not be allowed to examine any potential homicide victims until the Patrick administration completes a review of the state medical examiner's office. Below are some additional morsel on Dr. Zane and the State of MA competency.

Michelle McPhee (whom has written a book about Entwistle) did a podcast on 12.27.07 on the Zane factor in the Entwistle trial.

The medical examiner's office is under scrutiny by the Patrick administration and by a Virginia-based consultant, Vance, after numerous problems were recently discovered, including the misplacement of the body of a Cape Cod man who was mistakenly buried in another man's grave and had to be dug up last month.
The chief medical examiner, Dr. Mark A. Flomenbaum, was suspended with pay May 3 as a result of the misplacing of the body.
The Romney administration hired him in early 2005 to correct other problems at the office, which had been investigated by state and federal authorities after one of the medical examiners, possibly Zane, sent the wrong set of eyes for testing during an autopsy.
Summary: It ain't over until the fat lady sings! On a positive note, this trial is in the burbs of Boston versus Los Angeles!

My personal thoughts & respect for Joanna Gately

I did not get to view Joanna Gately's testimony until this evening. The first thing that struck me was how much she resembled my dead (murdered) sister Colleen Ann Smith Battaglia. For me, the resemblance in her face & hair, it was chilling and haunting. I must admit, this connection immediately caused me to feel an instant kinship towards Joanna Gately. The second reaction I had to Ms. Gately was the apparent grieve on her face in the loss of her dear college friend Rachel. Unfortunately, I can identify with the depth of her loss and will not even try to placate it with token words. It's hell.

Repeatedly, I was touched by the simple acts of kindness that Joanna and her sister Maureen demonstrated on the evening of January 21, 2006. She meets my criteria as a great friend and proper lady. Firstly, she got alarmed when Rachel was not @ home as planned. After finding Rachel's mom note left earlier in the day she promptly contacted Priscilla. These actions resulted in Priscilla calling the Hopkinton PD. Joanna in a second act of kindness, thought of Sally, the family dog, and repeatedly took care of Sally's basic needs. We can only imagine what Sally probably witnessed! And for anyone who listened to the complete testimony knows - Joanna's acts of love out of friendship did not stop at these two examples.

OK - here is how she meets my definition of a
proper lady! In the middle of the night whilst camped out in her car she drove to find an available bathroom. Versus my choice most probably would have been to squat in a bush @ 2 a.m. I, when it comes to bodily fluid urges, have no pride. I have been known to squat in a bush next to a pride of a lioness with her cubs in South Africa - what can I say!

Joanna, your distance stares into space as you relived the horrible and brutal end to your Rachel and her baby Lilly are what I see as I sit here editing the video of your testimony. I wish there was some fancy editing technique I could bestow upon you to magically have this pain disappear! I wish that from my own experience with the lost of a love one from a violent act I could state "it will get better". But the reality is that there will probably not be one day where your thoughts will not wonder back to Rachel. And definitely for every major event that happens in your future when you most need a female shoulder or friend to share life experiences with you - you will miss your dear friend called Rachel Souza Entwistle. You will never know what your life would have been like had Rachel lived. But you will now know what it is like since her death!

Lastly, thank you Joanna & Maureen Gately - from Rachel, Lilly & Sally :)

Not only man's best friend but Rachel's best friend.

Welcome Lady's visit 1/15/06 to murder on 1/21/06!


Pamela Jackson, the town of Hopkinton Welcome Lady, visited on Sunday afternoon (1/15/06) with the Entwistle family.

During her testimony she continually stated how "adorable and engaging" the parents were with baby Lilly. What went wrong between the 15th & 21st of January 2006???

Boston Herald reported that this testimony appeared to force Neil Entwistle’s broken-hearted British mom to leave court today. The emotional moment came during the third day of testimony in the double-murder trial of the 29-year-old Entwistle.

Neil’s father, Clifford, escorted his wife, Yvonne, out of Courtroom 430 this morning after the “Welcome Lady” testified. The elder Entwistle placed a comforting hand on the small of her back as he led her out of the court. She appeared visibly upset.

I have extracted portions of the Welcome Lady's testimony that were touching. Unfortunately (for voyeurism) there are no clips of this exit - hopefully - this was done out of respect for the family) none of the camera.
